Protecting Your Brand Identity: The Lifecycle of a Trademark in India
Why a Trademark is an Inestimable Asset
As your service quality scales, customers learn to identify you via your business name, custom logo, or catchy slogan. This is brand equity. If a competitor mirrors your name, it damages your conversions. A registered trademark gives you absolute legal rights to stop competitors from causing consumer confusion.
The Five Main Phases of intellectual Protection
1. Comprehensive Trademark Search: Before registering, an exhaustive database search must confirm that your logo or wordmark does not clash with existing active applications under relevant Nice Classification classes.
2. Application Filing: Your advisor compiles the form specifying current trademark usage date, applicant entity, and distinct features.
3. Trademark Examination: A government examiner evaluates the trademark against absolute grounds of refusal (e.g., generic words like 'Cold Water' cannot be trademarked) and relative similarity grounds.
4. Public Publication (Journal): Upon passing examination, the brand is published in the public Trademark Journal for a period of 4 months. This allows the general public to submit opposition claims if their proprietary rights are affected.
5. Registration: If no opposition is filed, the office issues a digital Certificate of Registration, valid for 10 years, and renewable indefinitely.
