Why a Trademark is an Inestimable Asset

The Five Main Phases of intellectual Protection

1. Comprehensive Trademark Search: Before registering, an exhaustive database search must confirm that your logo or wordmark does not clash with existing active applications under relevant Nice Classification classes.

2. Application Filing: Your advisor compiles the form specifying current trademark usage date, applicant entity, and distinct features.

3. Trademark Examination: A government examiner evaluates the trademark against absolute grounds of refusal (e.g., generic words like 'Cold Water' cannot be trademarked) and relative similarity grounds.

4. Public Publication (Journal): Upon passing examination, the brand is published in the public Trademark Journal for a period of 4 months. This allows the general public to submit opposition claims if their proprietary rights are affected.

5. Registration: If no opposition is filed, the office issues a digital Certificate of Registration, valid for 10 years, and renewable indefinitely.
